It permits the use of such evidence to establish the truth of facts in later judicial proceedings if the witness is deceased, missing, incapacitated, or deliberately kept away by an opposing party, or if their presence is unreasonably delayed or costly. This is applicable if the proceedings involve the same parties or their representatives, and if the opposing party had the opportunity to cross-examine in the initial proceeding with substantially similar issues. A criminal trial is considered a proceeding between the prosecutor and the accused.
