<h1>Employers Charged Under Clause 63 Can Summon Actual Offender to Court if Due Diligence Proven</h1> Under Clause 63 of the Code on Wages, 2019, an employer charged with an offence may request the court to summon another individual deemed the actual offender. If the employer demonstrates due diligence in enforcing the Code and proves that the offence occurred without their knowledge, consent, or connivance, the court may convict the actual offender instead. The employer can be discharged from liability if these conditions are met. During this process, the employer's testimony and that of any witnesses are subject to cross-examination by the accused individual and the prosecution.
