<h1>Section 167 Amended: Directors Disqualified Under Section 164(2) Retain Office in Defaulting Company Only; Appeal Provisions Updated.</h1> The Companies (Amendment) Act, 2017 modifies section 167 of the principal Act. In sub-section (1), clause (a) now includes a proviso stating that if a director incurs disqualification under section 164(2), their office becomes vacant in all companies except the defaulting one. Clause (f) is revised to allow directors to retain their office for thirty days following a conviction or disqualification order. If an appeal or petition is filed within this period, the office remains occupied until seven days after the appeal's resolution. Further appeals filed within seven days also allow the director to retain their position until resolved.
