Benami property inquiries: Initiating Officer may investigate with Approving Authority approval, but not after issuance of a section 24 notice.
The Initiating Officer is authorised, subject to prior approval by the Approving Authority, to conduct or cause inquiries or investigations into persons, places, property, assets, documents, books of account or other relevant matters under the Act; this provision centralises investigative power but conditions exercise on prior approval. An explanatory amendment excludes the operation of this power where the Initiating Officer has issued a notice under subsection (1) of section 24, thereby removing section 23's inquiry power in any case already proceeded by a section 24 notice. The provision was inserted by amendment in 2016 and later clarified in 2019.
