of <h1>Benami property: officials under the Act are declared public servants, exposing them to penal liability under IPC definitions.</h1> Chairperson, Members and officers of the Appellate Tribunal, Adjudicating Authority, Approving Authority, Initiating Officer, Administrator and their subordinates are expressly declared to be deemed public servants for the purposes of the Indian Penal Code, thereby attracting the legal consequences applicable to public servants under criminal law; this deeming rule was inserted by the 2016 amendment to the Benami Transactions (Prohibition) Act and operates to subject those office-holders to penal liability and investigatory provisions linked to the statutory definition of public servant.
