Benami Property Act overriding effect ensures its provisions prevail over any inconsistent law, binding authorities and tribunals.
Section 67 provides that the Act shall have overriding effect, taking precedence over any inconsistent law; this clause was inserted by the 2016 amendment effective 01-11-2016 and operates to ensure the benami prohibition regime displaces conflicting statutory or regulatory provisions. The operative effect is that, in cases of inconsistency, authorities and tribunals must apply the Act's provisions on benami property transactions rather than contrary provisions in other laws, making the Act the governing rule where conflicts arise.
