Benami property proceedings may be continued or initiated against the deceased's legal representative, including appeals to the Appellate Tribunal. Proceedings under the Prohibition of Benami Property Transactions Act may be continued or initiated against the deceased's legal representative; actions pending at death are deemed taken against the legal representative and may continue from the same stage, and proceedings that could have been taken against the deceased may be taken against the legal representative subject to specified exclusions. If property has been held benami, the legal representative may prefer an appeal to the Appellate Tribunal in place of the deceased, with appeal provisions applying as appropriate.
