Legal Representatives Continue Benami Property Proceedings and Appeals Under Relevant Act Sections
If a person dies during proceedings under the Benami Property Transactions Act, any ongoing proceedings against the deceased continue against their legal representative from the same stage. Proceedings that could have been initiated against the deceased may also be initiated against the legal representative, with most provisions of the Act applying accordingly. Additionally, if property has been declared benami, the legal representative is entitled to file an appeal to the Appellate Tribunal in place of the deceased, with relevant appeal provisions applying as appropriate.
