<h1>Benami transaction suits transferred to Adjudicating Authority or Appellate Tribunal; records forwarded and proceedings may continue de novo.</h1> Section 65 mandates that every suit or proceeding concerning a benami transaction pending outside a High Court at commencement of the Act is transferred to the Adjudicating Authority or Appellate Tribunal with jurisdiction. The originating forum must forward records promptly after transfer, and the Adjudicating Authority may deal with the matter from the stage reached, from an earlier stage, or de novo. The provision was inserted by the Benami Transactions (Prohibition) Amendment Act, 2016, effective 01-11-2016, thereby centralising adjudication and appellate review of pending benami matters under the specialized authorities.
