Benami property proceedings pending at commencement are automatically transferred to the adjudicating authority or appellate tribunal. Section 65 mandates automatic transfer of suits and proceedings concerning benami transactions (except those before a High Court) pending on commencement to the Adjudicating Authority or Appellate Tribunal. The transferring forum must forward records, and the Adjudicating Authority may proceed with the matter from the stage reached, from an earlier stage, or de novo, mirroring the approach to references under section 24(5).
