Special Courts Gain Jurisdiction Over LLP Cases Under Amended Section 77; Transfers From Magistrates Effective April 2022.
Section 77 of the Limited Liability Partnership Act, 2008, as amended by the Limited Liability Partnership (Amendment) Act, 2021, establishes the jurisdiction of Special Courts for cases involving limited liability partnerships (LLPs). These Special Courts have the authority to impose punishments under Section 30 of the Act. Additionally, criminal cases against LLPs, their partners, or other responsible individuals, which were previously handled by Judicial Magistrates or Metropolitan Magistrates, will be transferred to these Special Courts. This amendment took effect on April 1, 2022, replacing the previous jurisdictional provisions.
