Inspectors Can Seize Documents Under LLP Act Section 48 to Prevent Tampering During Investigations
Under Section 48 of the Limited Liability Partnership Act, 2008, an inspector may apply to a Judicial or Metropolitan Magistrate for an order to seize books and papers if there is a reasonable belief they might be destroyed or altered during an investigation. The Magistrate can authorize the inspector to enter premises, search, and seize necessary documents. Seized materials are held until the investigation concludes, with a maximum retention period of six months, after which they must be returned. The process follows the Code of Criminal Procedure, 1973, for searches and seizures. Identification marks may be placed on documents before return.
