Tribunal Options for LLP Winding Up: Dismiss, Interim Orders, Provisional Liquidator, or Winding Up Order - Section Reference Needed
The Tribunal, upon hearing a winding up petition for a Limited Liability Partnership (LLP), can dismiss the petition, issue interim orders, direct revival or rehabilitation actions, appoint a provisional liquidator, or order the winding up of the LLP. The Tribunal cannot refuse a winding up order solely because the LLP's assets are mortgaged or nonexistent. If the petition is based on the just and equitable ground, the Tribunal may reject it if an alternative remedy is available and the petitioners are deemed unreasonable. A Provisional Liquidator's powers may be restricted by the Tribunal but otherwise align with those of a liquidator.
