Joint Promises: Right to Claim Performance Transfers to Survivors and Representatives as per Contract Terms.
When a promise is made to two or more persons jointly, the right to claim performance lies with all of them during their joint lives, unless the contract specifies otherwise. Upon the death of any one of them, the right passes to the deceased's representative jointly with the surviving promisee(s). After the last survivor's death, the right to claim performance transfers to the representatives of all the original promisees jointly. For example, if A promises to repay a loan to B and C jointly, upon B's death, B's representative and C can claim performance, and after C's death, the representatives of both B and C can claim it jointly.
