Section 143A of Negotiable Instruments Act: Courts Can Order Interim Compensation for Dishonored Cheques Up to 20% of Amount.
Section 143A of the Negotiable Instruments Act, 1881, empowers courts to order interim compensation to be paid by the drawer of a dishonored cheque to the complainant. This applies when the drawer pleads not guilty in a summary trial or summons case, or upon framing of charges in other cases. The compensation can be up to 20% of the cheque amount, payable within 60 days, extendable by 30 days. If acquitted, the complainant must repay the compensation with interest. The compensation can be recovered as a fine, and any fines or compensation awarded will be reduced by the interim amount paid.
