<h1>Indorser Liable for Dishonored Negotiable Instruments Under Section 35 if Not Excluded in Endorsement.</h1> Under Section 35 of the Negotiable Instruments Act, 1881, an indorser who endorses and delivers a negotiable instrument before its maturity, without explicitly excluding or conditioning their liability in the endorsement, is liable to compensate subsequent holders for any loss or damage due to dishonor by the drawee, acceptor, or maker. This liability is contingent upon the indorser receiving due notice of such dishonor. After dishonor, the indorser's liability is akin to that on an instrument payable on demand.
