42nd Amendment Establishes Tribunals for Public Service Disputes; Articles 323-A and 323-B Define Powers and Jurisdiction
The Constitution (42nd Amendment) Act, 1976 introduced Part XIV-A, establishing tribunals for adjudicating disputes related to public service recruitment and conditions. Article 323-A allows Parliament to create administrative tribunals for the Union and States, defining their powers and excluding other courts' jurisdiction, except the Supreme Court's under Article 136. Article 323-B permits legislatures to establish tribunals for matters like taxation, labor disputes, and land reforms, with similar provisions for jurisdiction and procedure. These articles ensure tribunals' authority supersedes other constitutional or legal provisions, effective from January 3, 1977.
