1976 Amendment Expands All-India Services to Include Judicial Roles, Modifies Constitutional Clauses for Judicial Service Creation.
Article 312 of the Constitution was amended by the Constitution (42nd Amendment) Act, 1976. Clause (1) was modified to substitute 'Part XI' with 'Chapter VI of Part VI or Part XI' and to include 'all-India judicial service' within 'all-India services.' New clauses were added: Clause (3) specifies that the all-India judicial service will not include posts below a district judge as defined in Article 236. Clause (4) allows for laws creating the all-India judicial service to amend Chapter VI of Part VI without being considered a constitutional amendment under Article 368. These changes took effect on January 3, 1977.
