Supreme Court Holds Exclusive Power to Decide Constitutional Validity of Central Laws Under Article 131-A.
Article 131-A, introduced by the Constitution (42nd Amendment) Act, 1976, grants exclusive jurisdiction to the Supreme Court to determine the constitutional validity of Central laws. If a High Court identifies a case involving such constitutional questions, it must refer the matter to the Supreme Court. The Attorney-General can also request the Supreme Court to require a High Court to refer such questions. Once referred, the High Court must stay proceedings until the Supreme Court resolves the issue. The Supreme Court may then decide the case or return it to the High Court with its judgment for further action.
