Section 37E Allows Government to Publish Names in Excise Cases, Subject to Appeal Period Expiry or Resolution
Section 37E of the Central Excise Act, 1944, allows the Central Government to publish the names and details of individuals involved in proceedings or prosecutions under the Act if deemed necessary in the public interest. However, such publication is prohibited until the appeal period to the Commissioner (Appeals) or the Appellate Tribunal has expired without an appeal or the appeal has been resolved. The provision also permits the publication of names of partners, directors, or members of a firm, company, or association if justified by the circumstances. This section was introduced by the Taxation Laws (Amendment) Act, 2006.
