Ombudsman Can Request Info from Companies Under Regulation 15; Non-Compliance May Lead to Unfavorable Inferences
Regulation 15 of the Securities and Exchange Board of India (Ombudsman) Regulations, 2003, grants the Ombudsman authority to request information or certified documents from a listed company, intermediary, or other relevant entities related to a complaint. Non-compliance without sufficient cause may lead the Ombudsman to infer unfavorable conclusions against the company or intermediary. The Ombudsman must maintain confidentiality of the information, except as required by law or with consent, but may disclose information to parties involved in a complaint to ensure fairness. Disclosures to the Board or in legal contexts are exempt from confidentiality requirements.
