Regulation 15: Process for Presenting and Scrutinizing Petitions, Including Handling Defects and Escalation to Bench.
Regulation 15 of the Company Law Board Regulations, 1991, outlines the process for the presentation and scrutiny of petitions. Upon presentation, the Bench office endorses the date on each petition. If the petition is in order, it is registered and assigned a serial number. If defects are found, they may be rectified immediately if formal, or time may be given for rectification if not. If the petitioner disagrees with the Secretary or Bench Officer's decision regarding defects, the matter can be escalated to the Bench, where a single member can issue binding directions.
