<h1>New Article 192: Governor Decides State Legislature Member Disqualification with Election Commission's Opinion, Post-44th Amendment.</h1> Article 192 of the Constitution has been replaced by a new provision under the Constitution (44th Amendment) Act, 1978. The new Article 192 stipulates that if a question arises regarding the disqualification of a member of a State Legislature as per Article 191(1), it shall be referred to the Governor for a final decision. Before deciding, the Governor must seek and act upon the opinion of the Election Commission. This amendment came into effect on June 19, 1979.
