Supreme Court can withdraw cases from High Courts for similar legal questions after 44th Amendment, Article 139-A.
Article 139-A of the Constitution was amended by the 44th Amendment Act, 1978, to allow the Supreme Court to withdraw cases from High Courts if they involve the same or substantially similar questions of law that are of general importance. The Supreme Court can do this on its own motion or upon application by the Attorney-General or a party involved. After resolving the legal questions, the Supreme Court may return the case to the original High Court with its judgment, and the High Court must then proceed in accordance with that judgment. This amendment took effect on August 1, 1979.
