Penalty for repeated default increases liability to double penalty where the same default recurs within a specified recurrence period. A new provision imposes enhanced liability where a company, officer, or other person previously penalised under the Act again commits the same default within a three year recurrence period from the date of the adjudicating officer's or Regional Director's penalty order; for any second or subsequent default within that period the liable party is subject to a penalty equal to twice the amount prescribed for that default under the relevant provisions of the Act.
