Liability to a penalty replaces criminal framing, establishing a fixed penalty and daily continuing penalty cap. Amendment revises section 137(3) to replace 'punishable with fine' by liable to a penalty, removes imprisonment and the previous fine clause, and provides a fixed initial penalty of one lakh rupees plus a continuing daily penalty of one hundred rupees after the first day of failure, subject to a maximum aggregate of five lakh rupees.
