Director Disqualification Rules Updated: Section 167 Amended for Office Vacancies and Appeals Timeline Extensions
Section 167 of the principal Act is amended to address director disqualification. A new proviso in clause (a) states that if a director incurs disqualification under section 164(2), their office becomes vacant in all companies except the defaulting one. In clause (f), the proviso is revised to allow a director to retain their position for thirty days following a conviction or disqualification order. If an appeal or petition is filed within those thirty days, the director remains in office until seven days after the appeal's resolution. Further appeals within seven days also extend the director's tenure until resolved.
