Regulation 39: Proceedings Continue Despite Party's Death or Insolvency in Competition Law Cases
Regulation 39 of the CCI (General) Regulations, 2024, under the Law of Competition, addresses the continuation of proceedings in the event of a party's death or insolvency. If a party involved in a proceeding before the Commission dies, is declared insolvent, or, in the case of a company, is wound up, the proceedings do not terminate. Instead, they may continue with or against the deceased party's executor, administrator, or legal representative, or against the assignee, receiver, or liquidator, depending on the circumstances.
