Proceedings in absence: regulator may continue hearings and decide on available facts; orders recallable if participation prevented. Regulation 31 authorises the Commission to continue proceedings and pass appropriate orders when a party fails to appear after service of notice or after adjournment; it may also decide on the basis of available facts if a party refuses or fails to provide necessary information or significantly impedes investigation. Where a party later shows it was prevented from participating or from furnishing required information for reasons beyond its control, the Commission may, upon satisfaction, recall the order.
