Regulation 45 Empowers CCI to Issue Commissions for Witness Examination and Document Review in Key Situations
Regulation 45 of the CCI (General) Regulations, 2024, empowers the Commission or the Director General to issue commissions for examining witnesses or documents. This can be done on their own motion or upon application by a party involved in proceedings. Witnesses may be examined if they reside in India, are about to leave India, are government employees unable to attend without affecting public service, are sick, live over 500 kilometers away, or if their testimony is crucial for justice. Commissions can also be issued for witnesses abroad or for documents, with appointed public servants or counsel executing the commission. The Commission or Director General will provide necessary instructions and set a return date for the commission.
