Prohibition of Benami Property Transactions Act amendments expand procedural timelines and introduce conditioned immunity allowing disclosures.
Amendments to the Prohibition of Benami Property Transactions Act extend and reframe procedural timelines and add a formal immunity mechanism. Notice response and submission periods are lengthened (responses to be furnished within the notice period or up to three months; specified 90day limits replaced by four months; attachmentrelated timelines moved to one month from monthend). A new power permits the Initiating Officer, with prior competent authority sanction, to tender immunity from prosecution to a benamidar or other nonbeneficial person conditioned on full and true disclosure; accepted immunity bars prosecution and penalties to the extent granted, and may be withdrawn if the condition is breached, enabling prosecution thereafter.
