Securities Regulation 33B: Procedure for Officer Recommendations and Orders for Intermediaries Outlined
Regulation 33B of the Securities and Exchange Board of India (Intermediaries) Regulations, 2008 outlines the procedure for proceedings under this chapter. The Chairman or a member may appoint an officer, not below the rank of Assistant General Manager or Assistant Legal Advisor, to make recommendations after following the prescribed procedure. If an intermediary requests to dispense with this procedure, the Chairman or member may decide accordingly. The appointed officer issues a notice to the intermediary for a written submission within a specified period. Based on the intermediary's response or lack thereof, the officer submits a report with recommendations for action, which the Chairman or member then considers to pass appropriate orders. A common order may be issued for multiple intermediaries if the cases are similar.
