<h1>Revocation of trusts under Section 78: Consent needed from all competent beneficiaries or creditors for non-testamentary trusts.</h1> Section 78 of the Indian Trusts Act, 1882, addresses the revocation of trusts. A trust created by a will can be revoked at the testator's discretion. Other trusts may be revoked if all beneficiaries, who are competent to contract, consent; if the trust was declared by a non-testamentary instrument or verbally, and a revocation power was reserved; or if the trust is for settling the author's debts and has not been communicated to creditors, allowing revocation at the author's discretion. If creditors are involved, their consent is necessary for revocation.
