Trusts Must Have Lawful Purpose Under Indian Trusts Act, 1882; Unlawful Purposes Render Trust Void
A trust under the Indian Trusts Act, 1882, must have a lawful purpose, which is defined as not being forbidden by law, not defeating legal provisions, not being fraudulent, not causing injury to others, and not being deemed immoral or against public policy by the court. Any trust with an unlawful purpose is void. If a trust has both lawful and unlawful purposes that cannot be separated, the entire trust is void. The term 'law' includes foreign laws when the trust property is immovable and located abroad. Examples include trusts for illegal activities or those that harm creditors.
