Beneficiary capacity: persons able to hold property may be beneficiaries and may renounce interests by disclaimer or inconsistent claim. Every person capable of holding property may be a beneficiary; a proposed beneficiary may renounce the interest by disclaimer to the trustee or by asserting, with notice of the trust, a claim inconsistent with the trust that effectively abandons the beneficiary interest.
