Capacity to create trusts: competent persons may create trusts; minors need permission under governing law. A trust may be created by any person competent to contract, subject to laws governing the circumstances and extent of disposal of trust property; trusts for or on behalf of a minor require the permission of the appropriate civil authority and remain subject to the governing law on disposition and extent of the trust property.
