Adjudicating authority under benami property law now is the competent authority under the Smugglers and Foreign Exchange Act. The competent authority authorised under sub section (1) of section 5 of the Smugglers and Foreign Exchange Manipulators (Forfeiture of Property) Act, 1976 is designated as the Adjudicating Authority under the Prohibition of Benami Property Transactions Act, 1988 and shall exercise the jurisdiction, powers and authority conferred by or under that Act.
