SEZ unit exit conditions require payment of duties, potential penalties, bank guarantees, and legal undertakings for exit. Units may opt out of a Special Economic Zone with Development Commissioner approval on payment of applicable duties on capital goods and stocks; exit of units failing to achieve positive foreign exchange may attract penalties. Exit requires payment of adjudicated penalties or, if an appeal is pending, a stay order plus a bank guarantee unless exempted; failure to fulfil Letter of Approval terms demands a legal undertaking for prospective penalties. Units remain treated as units until final exit. Gems and jewellery stocks must be handed to a nominated agency; an EPCG scheme option and prescribed depreciation norms apply, and an undertaking in Form L is required.
