It mandates that no penalty can be imposed without providing the concerned party with a show cause notice and a reasonable opportunity to present their case before the Commission. If the Commission decides to issue a show cause notice, the Secretary must provide at least fifteen days for the party to submit a written explanation. The Commission will then consider the explanation and, if necessary, conduct an oral hearing before deciding on the imposition of a penalty based on the case's facts and circumstances.
