          <h1>Prima facie case determination directs Commission to record an opinion on anti-competitive conduct within prescribed statutory timelines.</h1> The Secretary must scrutinise an information or reference, remove defects and place it before the Commission so the Commission can form an opinion on the existence of a prima facie case; in alleged anti-competitive agreements and abuse of dominant position matters the Commission should, as far as possible, record that opinion within the prescribed statutory period and convene its first ordinary meeting within a further short prescribed period after placement.
