Regulation 45 allows CCI to issue commissions for witness examination, crucial for proceedings, even outside India.
Regulation 45 of the CCI (General) Regulations, 2009 empowers the Commission or Director General to issue commissions for examining witnesses or documents in proceedings. This can be initiated by the Commission, Director General, or upon application by a party. Witnesses can be examined if they are in India, unable to attend due to various reasons, or if their evidence is crucial. Commissions can also be issued for witnesses outside India, with assistance from Indian embassies. A public servant or counsel acts as 'the commissioner' to execute the commission, and must return the evidence to the Commission or Director General by a specified date.
