Special Court jurisdiction clarified: closure report required if no money laundering offence; complaint scope expanded for further investigation.
Amendments to section 44 require that, if after investigation no money laundering offence is made out, the investigating authority must submit a closure report to the Special Court. An Explanation clarifies that the Special Court's jurisdiction under the Act is not dependent on orders in respect of the scheduled offence and that trial of both offences by the same court is not a joint trial. The Explanation further provides that a complaint includes any subsequent complaint arising from further investigation to bring additional oral or documentary evidence against accused persons, whether named initially or not.
