SEBI Regulation 45: Process for Trustee Registration Cancellation, Suspension, and Scheme Winding Up
Regulation 45 of the Securities and Exchange Board of India (SEBI) outlines the process for cancelling or suspending the registration of a trustee under certain conditions. If a trustee fails to comply with the conditions of their certification or violates relevant laws, their registration may be revoked or suspended, provided they have an opportunity to be heard. The SEBI may also order the winding up of schemes, meaning liquidation of assets and repayment to investors. Even after cancellation, the trustee must comply with regulations until a new trustee is appointed or schemes are wound up. This regulation does not affect other legal provisions under SEBI or related laws.
