<h1>Anti-Dumping Duties Effective Upon Gazette Publication; Possible Retroactive Application Under Section 9A(3) for Certain Cases.</h1> The anti-dumping duty under rules 13 and 19 becomes effective upon publication in the Official Gazette. If a provisional duty was imposed and a final finding of injury or threat of injury is recorded, the duty may apply from the provisional duty's imposition date. In certain cases under section 9A(3) of the Act, the duty may be retroactive to ninety days before the provisional duty's imposition, excluding imports for home consumption before the investigation began. In cases of price undertaking violations, duties are not retroactive on imports before the violation, but provisional duties apply from the violation date or as specified by the Central Government.
