Compounding of offences permits settlement of non custodial violations before prosecution, subject to conditions and central supervision. Section 41 permits compounding of non imprisonment offences under the Act before prosecution for sums specified by the Central Government, subject to a temporal limitation on repeat offences. Compounding authorities act under Central Government supervision; applications must follow prescribed form, manner and fee. Valid compounding bars subsequent prosecution for the same offence. Authorities may, as part of compounding for defaults in required permissions or filings, order the filing or registration of the specified returns, accounts or documents within a time specified in the compounding order.
