of <h1>Aadhaar Act Update: Penalties for Misuse of Identity Information Under Section 40, Including Jail Time and Fines.</h1> Section 40 of the Aadhaar Act has been amended to impose penalties on entities that misuse identity information. If a requesting entity uses an individual's identity information against the provisions of section 8(2), or if an offline verification-seeking entity does so against section 8A(2), they face penalties. These include imprisonment up to three years, a fine up to ten thousand rupees, or for companies, a fine up to one lakh rupees, or both.
