Insolvency Board Regulations: Service Providers Must Cooperate with Inspections, Provide Records, and Assist Inspecting Authority.
The Insolvency and Bankruptcy Board of India (Inspection and Investigation) Regulations, 2017, outlines the procedures for conducting inspections. The Inspecting Authority must notify the service provider at least 10 days prior, unless delay risks record tampering. The service provider and associated persons must submit necessary records and facilitate on-site inspections. They are required to provide access to premises, produce relevant records, and assist the Inspecting Authority. The Inspecting Authority can also examine and record statements from associated persons regarding the business affairs during the inspection.
