Goods Failing Origin Criteria Under MERCOSUR-India Trade Agreement Face Non-Member Duties and Potential Sanctions
If an investigation finds that goods do not meet the origin criteria under the Preferential Trade Agreement between MERCOSUR member states and India, duties will be imposed as if imported from non-member countries, and applicable sanctions will be enforced. The importing party may deny preferential tariffs on future similar imports from the same producer until compliance is demonstrated. Upon receiving proof of modified manufacturing conditions, the importing party has 45 days to decide, extendable to 90 days if further verification is needed. Unresolved disputes may be addressed through the Agreement's Dispute Settlement Procedure.
