Section 25 of Sales of Goods Act: Seller Retains Ownership Until Conditions Met in Sales Contract
Section 25 of the Sales of Goods Act, 1930, addresses the seller's reservation of the right of disposal in a sales contract. It allows the seller to retain ownership of the goods until specified conditions are met, even if the goods are delivered to the buyer or a carrier. If goods are shipped with a bill of lading or railway receipt indicating delivery to the seller's order, the seller is presumed to reserve this right. If the seller draws a bill of exchange for payment and the buyer fails to honor it, the buyer must return the bill of lading or railway receipt, or ownership remains with the seller.
