Section 12B Empowers Commission to Suspend Association Members for Up to Three Years in Public Interest
Section 12B of the Forward Contracts (Regulation) Act, 1952, grants the Commission the authority to suspend a member of a recognized association or prohibit them from trading in forward contracts if deemed necessary for trade or public interest. This can be done regardless of existing laws or association rules, after giving the member a chance to be heard. The suspension or prohibition can last up to three years. Orders do not affect the validity of contracts made before the order, but provisions for closing out such contracts may be included in the order.
