Preferential tariff treatment may be denied pending guarantees to preserve fiscal interests under origin determination rules.

Rule 20 provides that customs authorities shall not suspend importation operations of the goods or identical goods from the same exporter or producer, but may deny preferential tariff treatment and require a guarantee or take actions necessary to preserve fiscal interests as a pre-condition to completing importation, in accordance with the importing Party's laws; any guarantee required shall not exceed the value of the applicable customs duties for importation from third countries under the importing country's legislation.
