India-Chile Trade: Rule 6 Defines Preferential Origin Criteria for Goods with 60% Non-Originating Materials Limit
Rule 6 of the Rules of Determination of Origin of Goods under the Preferential Trading Agreement between India and Chile specifies criteria for products not wholly produced or obtained. Products are eligible for preferential treatment if non-originating materials do not exceed 60% of the FOB value and the final manufacturing process occurs in the exporting country. Non-originating materials must be sufficiently processed to fall under a different Harmonized System heading than their original classification. The customs value of these materials is based on CIF value or the earliest price paid. Additionally, a product can be considered originating if it meets conditions in the Annex.
